This document represents a legally binding contract (‘the contract’) between the company FRESH START ADVISORY (ACN 650 256 358) (also referred to herein as ‘the Host’) and the Participant listed above. Both the Host and the Participant agree to the following conditions:
FRESH START ADVISORY will provide the Participant with their own comprehensive guide to property investment in a 16-week ‘Do It Yourself’ Property Investment online workshop (‘the workshop’). The Host has designed the kit with the aim that it will:
- Guide people to securing a high-yielding investment property.
- Make informed decisions with access to comprehensive location reports and analysis on Australian property hot spots.
- Craft a strategic and well-defined 10-year plan for property investment journey.
- Give a competitive edge by leveraging expert knowledge and research to identify the best investment opportunities.
- Master Fresh Start Advisory’s ‘7-Step’ process for successful property investment.
- The 7 Key Modules that are covered in the kit are as follows:
- Creating a comprehensive 10-year plan for property investment success.
- Mastering due diligence on properties, including location analysis, zoning considerations, insurance quotes, and cash flow analysis.
- Navigating the 72-step research process for property selection.
- Understanding how to identify and evaluate hotspot locations for investment opportunities.
- Exploring top hot spot locations and their potential for high returns.
- Mastering the art of sourcing and negotiating properties effectively.
- Learning the essential post-contract exchange checklist for a seamless property acquisition process.
- The Participant agrees to pay the Host a fee of $3,897.00 (inclusive of GST) for the 16-week DIY Property Investment Kit. The total fee is payable at the Participant’s registration via the ‘Thinkific’ link provided, and once paid is non-refundable under any circumstances.
- The Host will provide online support details of which will be provided once the workshop commences. The support will grant the Participant the following:
- Exclusive access to online FAQ (Frequently Asked Questions) sessions held on a fortnightly basis via zoom. The frequency and/or duration of the online sessions may differ from time to time.
- Engagement in group discussions via zoom on a fortnightly basis with fellow Participants and a member from Fresh Start Advisory.
- 24/7 access to support via email.
- At the Cessation Date, the Participant will be offered the opportunity to engage and retain the Host’s Buyer’s Agency Services via a separate contract. If the Participant chooses to engage and retain the Host’s services offered, the full fee paid by the Participant pursuant to this contract for the ‘16-week DIY Property Investment Kit Workshop’, totaling $3,897.00 inclusive of GST, will be deducted from the Host’s retainer fee for the subsequent Buyer’s Agency services engaged. Should the Participant choose not to retain the Host’s Buyer’s Agency services when offered at the expiration of the 16 week workshop, the Participant’s fee paid pursuant to this contract for this 16-week DIY Property Investment Kit Workshop will not be discounted from any future retainer fee, and the Host’s full retainer fee applicable at that time for the Buyer’s Agency services will be chargeable and payable.
- The Participant acknowledges and understands that they do not have any right whatsoever either throughout the duration of this contract or thereafter, to distribute any information, documentation, materials, software, and/or resources provided in this workshop, to any other individual, third party, entity, company, or the like, for either personal, professional, educational and/or voluntary use and/or reasons.
- The Host will at all times, use its best endeavours to ensure that the Participant’s personal information and data is confidential information and is to be kept confidential unless it is required to disclose that confidential information by operation of any applicable law or court order.
- The Participant acknowledges that the Host does not hold a financial services license as defined in s913B of the Corporations Act 2001 (Cth) and is not authorised to provide financial services or advice.
- The Participant acknowledges that it is entirely responsible for its own final (if any) property investment and/or purchasing decisions and that the Host makes no guarantees or warranties of any kind in relation to any property the Participant may choose to purchase off their own volition or with the guidance of the kit resources, materials and support provided by the Host’s agents and/or employees, during the workshop or after the cessation of same.
- The Participant acknowledges that under no circumstances will the Host be liable for any loss, damage, costs or compensation arising out of, or in connection with, the Participant’s decision to purchase the Property.
- The Participant acknowledges that any data, information or advice provided by the Host to the Participant in relation to the property market, properties identified and introduced during the workshop and the Property (Market Data) is of a general nature only.
- The Participant acknowledges that the provision of any such Market Data does not constitute financial or investment advice nor should it be relied upon as such.
- The Participant acknowledges that the Host may recommend third parties throughout the workshop (including without limitation conveyancers, solicitors, mortgage brokers, building and/or pest inspection companies, strata searching companies, valuers and surveyors) in relation to the guidance for the purchase of a property. The Participant acknowledges that all third parties are independent of the Host and under no circumstances will the Host be liable for the advice, acts, or omissions of such third parties.
- The Participant accepts full responsibility for satisfying itself in relation to all aspects of the Property (including without limitation the building integrity, planning regulations which apply to the Property, the neighbourhood of the Property, any other information of importance to the Participant and the financial consequences of purchasing the Property).
- The Participant acknowledges, understands, and agrees that throughout the duration of the workshop and after cessation of same, they will not by any means whatsoever, directly or indirectly:
- Attempt in any manner to persuade a client to cease dealing with or to reduce the dealings which that client has customarily had or contemplated having with the Host.
- Attempt in any manner to persuade a broker to cease dealing with or to reduce the dealings that broker has customarily had or contemplated having with the Host.
- Attempt in any manner to persuade any fellow employee or contact of the Host with whose skills and abilities you have become familiar in the course of the workshop to cease providing services or be in connection with the Host and/or to provide those services to you or another person/entity/company.
- Attempt in any matter to persuade a client or broker to cease dealing with or reduce dealings with the Host, for your personal gain or for the gain of another company for which you may gain employment with after the cessation of the workshop, or for another company, person, organisation or entity.
- The Participant acknowledges, understands and agrees that:
- All intellectual and industrial property rights in confidential information (including but not limited to, all workshop resources, information, documentation, materials, links and guides) and any modifications and enhancements to confidential information are owned by the Host.
- Any inventions or works created during the workshop are owned by the Host and are not to be used by the Participants own individual or company benefit or for the benefit of any other third-party individual or entity.
- Without prejudice to any other remedy that the Host may have, the Host will be entitled to injunctive and/or other equitable relief to prevent or cure any breach or threatened breach of this section.
- The Participant holds the Host harmless and indemnifies the Host (and its subsidiaries, affiliates, officers, related parties, employees, contractors, agents, co branders or other partners) from and against any claims (including third party claims), actions, liabilities, damages, costs, charges or expenses (including but not limited to legal fees) the Host incurs or becomes liable to pay in respect of the subject matter of this contract, the Services, Confidential Information, Intellectual Property Rights, including any action taken by third parties against the Host and in respect of the subject matter of this contract.
- This contract constitutes the entire agreement between the Participant and the Host as to the subject matter and all previous communications and representations, either oral or written, made or entered into prior to the date of this contract are rendered invalid.
- The Participant will be deemed to have accepted the terms of this contract upon the Participant’s electronic execution via ‘Thinkific’, done so by ticking to agree to the Terms and Conditions to continue with transaction.
